Agreement to Terms

By accessing or using the BASH website or mobile application (collectively, the “Platform”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use our services.

 

Eligibility

You must be at least 18 years old to use BASH. By using the Platform, you represent and warrant that you meet this requirement.

Services Provided

BASH provides on-demand delivery of beauty, grooming, and everyday essentials. Product availability may vary based on location, inventory, and time of day.

Orders, Fees, and Delivery

All orders are subject to acceptance. A delivery fee of $3.95 applies to all orders under $50. Orders are typically delivered within 45 minutes, but timing may vary due to high demand or external factors.

Cancellations and Refunds

Once an order is confirmed, it cannot be canceled. Refunds or replacements are considered on a case-by-case basis for damaged or missing items. Contact us at support@bashphl.com within 24 hours of delivery.

Intellectual Property

All content on the Platform, including logos, images, branding, and technology, is owned by or licensed to BASH Beauty and Supply Haul. You may not reproduce or use any content without express permission.

 Limitation of Liability

To the fullest extent permitted by law, BASH is not liable for indirect, incidental, or consequential damages arising from your use of our services. All services are provided 'as is' without warranties of any kind.

Dispute Resolution – Mutual Arbitration, No Class Actions

Any dispute or claim relating in any way to this agreement or the services will be resolved on an individual basis by final and binding arbitration, rather than in court. You may assert claims in small claims court if applicable. No judge or jury will be present, and class actions are not permitted. This provision is governed by the Federal Arbitration Act.

 Applicable Law, Venue, and Jurisdiction

These terms are governed by the laws of the State of Pennsylvania, without regard to conflict of laws. You consent to exclusive jurisdiction and venue in state and federal courts located in Philadelphia County, PA.

Export Laws

You agree not to export or re-export BASH services or any portion thereof in violation of any applicable laws or regulations.

Taxes

You are solely responsible for any applicable taxes, duties, levies, or fees in connection with your use of BASH.

Injunctive Relief

BASH reserves the right to seek equitable relief for violations of these Terms, including injunctions or restraining orders without bond or proof of damages.

Modifications to Terms

BASH may modify these Terms & Conditions at any time. Continued use of the Platform indicates your acceptance of the updated terms.

 Miscellaneous

These Terms constitute the entire agreement between you and BASH and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions shall remain in full force. BASH's failure to enforce any provision shall not be a waiver.

Ownership and Intellectual Property

The Services and their content, including their “look and feel” (e.g., text, graphics, images, logos), proprietary content, information, and other materials, are protected under intellectual property, copyright, trademark, and other laws. You acknowledge and agree that BASH Beauty and Supply Haul and/or its licensors own all right, title, and interest in and to the Services (including, without limitation, any and all patent, copyright, trade secret, trademark, show-how, know-how, and any and all other intellectual property rights therein or related thereto), and you agree not to take any actions inconsistent with such ownership interests. You do not acquire any rights or licenses under any of BASH’s (or its licensors’) patents, trademarks, copyrights, or other intellectual property rights by using the Services.
